By using this Website or making a purchase either electronically via this Website, or by phone or fax, or in person, you agree to be bound by all these Terms (“Agreement”).

The following are the Terms that govern consumers' use of the Website. Little Planet Trading PLT (“Little Planet”), reserves the right to change, amend, modify, add, remove any or all of these Terms without notice. Little Planet takes all reasonable efforts to include accurate and up-to-date information on the Website. However, Little Planet makes no warranties or representations as to the accuracy of the information. Little Planet assumes no liability or responsibility for any errors or omissions in the contents of this Website. 

Warranty
Your use of and browsing on this Website is at your risk. Neither Little Planet nor any other party involved in creating, producing or delivering the Website is liable for any direct, indirect, incidental, consequential or punitive damages arising out of your access to, or use of, the Website. Without limiting the foregoing, everything on the Website is provided to you "as is" without warrant of any kind, either expressed or implied including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Please note that some jurisdictions may not allow the use of implied warranties, so some of the above exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties. Little Planet also assumes no responsibility and shall not be liable for any damages to, or viruses that may infect, your computer, equipment or other property on account of your access to, use of, or browsing in the Website or your downloading of any materials, data, text, images, video, or audio from the Website.

Communication
Any communication or material you transmit to the Website by electronic, mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by Little Planet or its affiliates for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast, and posting. Furthermore, Little Planet shall be entitled to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Website for any purpose whatsoever, including but not limited to developing, manufacturing, and marketing products using such information. 

Product 
Little Planet has made all reasonable efforts to accurately display the sizes, colours, shapes and patterns of the products for sale on the Website. You acknowledge and accept however that sizes, colours, shapes and patterns shown on the Website are approximate only. Colours in particular may differ due to your own computer visual settings and hardware.

Product information
Little Planet products displayed on the Website are available in Malaysia and selected markets outside Malaysia while supplies last. In some cases, products displayed for sale on the Website may not be available at all times. The prices displayed on the Website are quoted in Malaysian Ringgit and are valid and effective only in Malaysia for purchases made through the Website.

Price, Customs and Import Duties
The price payable for product that you order is as set out in the Website. The price payable for products exclude delivery charges. Delivery charges are shown separately when ordering your products. Little Planet reserves the right to change the prices without notice. Prices are inclusive of Malaysia Sales and Service Tax but is exclusive of any applicable customs and import duties. Any customs and import duties that may be incurred on the product upon arrival at its destination country must be paid by you. 

Cancellation of order by Little Planet
Little Planet reserves the right to cancel the order if:

1. it does not have sufficient stock to deliver the product you have ordered; or
2. it does not deliver to your area or country; or
3. if one or more of the product you ordered was listed with incorrect information including without limit price, and/or description or for whatever reason; or
4. if it has reason to believe that you will fail to pay for the products or that you will not comply with these Terms.

Delivery of Products to You
Little Planet will deliver the products ordered by you to the address you provide for delivery at the time you make your order. You will become the owner of the products you have ordered when you have paid for them and when they have been delivered to you. Once products have been delivered to you they will be held at your own risk and Little Planet will not be liable for their loss or destruction.

Liability and Limitation
If the products are not what you ordered or are damaged when you receive them or the delivery is of an incorrect quantity, Little Planet shall not be liable to you unless written notice is given by way of e-mail to [email protected] within seven (7) working days from the date of delivery of the products in question.

Little Planet will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising and in any event its maximum liability to you shall be to refund to you the amount paid by you for the products giving rise to the claim. 

Little Planet will not be liable for improper remedy of defective products, alteration of the products, unsuitable or improper use, willful damage, negligence, or other misuse of the products, as well as fair wear and tear, by you or any third party.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase products from the Website. The importation or exportation of certain of the products listed on the Website may be prohibited by certain national laws. Little Planet makes no representation and accepts no liability in respect of the export or import of the products you purchase.

Indemnification
You agree to defend, indemnify and hold Little Planet harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Website and/or Products.

Links to other websites
The Website may contain links to third party websites that are not affiliated with or owned, operated, or controlled by Little Planet, including third party payment system providers. You acknowledge and agree that Little Planet is not responsible for the content, privacy policies, or practices of such third party websites or the companies that own them. By using the Website, you expressly relieve Little Planet from any and all liability arising from your access and use of any third party website.

We encourage you to review the terms and conditions and privacy policies of any third party websites before using them and disclosing your personal data to them.

Intellectual Property Rights
Little Planet is the owner or the licensee of all intellectual property rights in and to the content on the Website, and in the material published on it. You may not copy, reproduce, modify, republish, upload, post, transmit, adapt, download, distribute or howsoever deal with any content or material from the Website in any form or by any means without Little Planet’s prior written permission, and you are solely responsible for obtaining such permission before dealing with any content or material that is available on the Site.

Disclaimer
In no event shall Little Planet or any of its affiliated entities, suppliers or retailers be liable for any indirect, special, punitive, incidental, exemplary or consequential damages under contract, negligence or any other theory, arising out of or in connection with the use, inability to use or performance of the information, services, products and materials available from the Website. These limitations shall apply notwithstanding any failure of essential purpose or the existence of any limited remedy.

Inaccuracy disclaimer
From time to time there may be information on this Website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. Little Planet reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). 

Third-party trademarks
Third-party trademarks, trade names, product names and logos, contained in this Website may be the trademarks or registered trademarks of their respective owners.

Notices
Unless otherwise expressly stated in these Terms, all notices or communications from you to Little Planet must be in writing and sent to [email protected].

Force Majeure
Little Planet shall not be liable or deemed to be at fault for any delay or failure in the performance of its obligations under this Agreement due to any circumstances beyond its reasonable control including but not limited to strikes, lock-outs, terrorism and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident, pandemic, emergencies, insurrection, acts of God, inaction or request of any governmental authority, shortages or other circumstance beyond Little Planet’s reasonable control (each such occurrence or circumstance, a “Force Majeure”); provided, however, that Little Planet shall make every good faith effort to overcome or dispel the event of Force Majeure and shall immediately communicate the occurrence of such Force Majeure to you.

Severability
In the event that any one or more of the Terms in this Agreement shall for any reason be held to be unenforceable, illegal or otherwise invalid in any respect, such unenforceability, illegality or invalidity shall not affect or impair any other provisions of this Agreement. 

Privacy Policy
By using the Website, applications or by otherwise giving Little Planet your personal information, you are authorising and agreeing that Little Planet may collect, store, use, share, process and act upon the information and may provide or disclose the same to its authorized administrative and business support third parties (Authorised Third Parties) (Privacy Policy).

If you do not agree to this Privacy Policy, please do not use the Website or applications or give Little Planet any of your personal information. 

Exchange and Returns 
All sales and promotional items are not eligible for exchange or return unless the delivered products are defective or damaged. 

 All requests for exchange and returns must be made in writing by way of e-mail to [email protected] within seven (7) working days from the date of delivery. Little Planet reserves its rights to accept or reject any requests for exchange and returns and will notify you of its decision within seven (7) days upon receipt of such request.

Once the request for exchange or return has been accepted, you will have to deliver the products to Little Planet within seven (7) days from the date of the approval of such request. 

Failure to comply with the time limit as set out above shall render all requests for exchange or return void and you shall be deemed to have accepted the products. 

Governing law
This Agreement shall be governed by and interpreted in all respects in accordance with the laws of Malaysia and all parties irrevocably agree to submit to the exclusive jurisdiction of the Malaysian courts.
